Please read these terms & conditions carefully before
completing and returning our booking form. Once a completed booking form has
been accepted in writing by Tamarack all persons named on the booking form
(the client) will have a binding contract on the basis of these terms and
conditions. If you have any questions about them please do not hesitate to
contact us.
Tamarack means Tamarack Group, Tamarack Outdoors, Unit 4,
Creamery Industrial Estate, Kenlis Road, Barnacre, Lancashire, PR3 1GD
1. Agreement
Agreement of these terms and conditions arise on the acceptance of Tamarack
of a completed booking form for any of its courses.
Tamarack reserves the right, in its absolute discretion and with no need to
give a reason, to refuse to accept a booking. In such a case any deposit
paid will be returned in full.
The agreement is between Tamarack and the client and is the sole agreement
between those parties. No variation will be made to these terms and
conditions unless confirmed in writing by Tamarack.
The agreement is governed by English Law.
2. Payment
The balance in full must be paid by a minimum of 28 days prior to any course
commencing. If not paid Tamarack reserves the right to treat the booking as
cancelled by the client as applying to clause 3.
3. Cancellation by Client.
If the client for any reason cancels the booking the following cancellation
charge will arise.
Cancellation made 3-8 weeks before course £25 fee payable.
Cancellation made less than 3 weeks before the course 75% of fee payable.
And the client acknowledges that it is reasonable for such charges due to
the need for Tamarack to make preparations for the course substantially in
advance.

4. Conduct of a course
The client acknowledges that during a Tamarack Course he/she is required to
follow the reasonable instructions of the leadership of Tamarack. Any
parents or teachers must maintain the control of children to the
satisfaction of Tamarack. Good conduct is expected at all times from both
instructors and clients. If in the event of disorderly or abusive behaviour,
intoxication, failure to control children, improper clothing or incapacity
to meet the rigours of a course, Tamarack has the right without question to
arrange removal of him/her from the course. Tamarack will not be liable to
any refund in this event.
5. Liability
Tamarack courses take place in the open countryside. By its nature this is
not absolutely free from hazard. Tamarack makes every effort to minimise all
risks but some will always remain. As such the client acknowledges that
he/she is taking part on a Tamarack course at his/her own risk.
Tamarack will only accept responsibility for injury as a result of
negligence on the part of Tamarack.
The client accepts that any loss outside negligence of Tamarack such as loss
of money or loss or damage to clothing or equipment is not the
responsibility of Tamarack and that Tamarack’s liability is hereby limited.
6. Insurance
Tamarack can arrange insurance for all courses the cost of which will vary
depending on the course length. The client is advised to familiarise his/her self
with the extent of the cover and to satisfy him/her self that it is adequate
to there needs. The client acknowledges that information given to Tamarack
will form part of the application for such cover and appreciates the need to
give a full and frank disclosure on all booking forms.
7. Complaints
In the unlikely event of a complaint about a Tamarack course, the complaint
must be made to the course instructor in the first instance so that Tamarack
may rectify any problem. If the complaint is not resolved to the client’s
satisfaction then a formal complaint should be made in writing to Tamarack
within 28 days from the end of the course. Tamarack will not be liable in
any respect to a complaint made after the 28 days.
8. Travel Documents.
The client is solely responsible, where necessary, for ensuring that he/she
has all necessary travel documents.
